The importance of a summons should not be underestimated. Judicial Summons — Served on a person involved in a legal proceeding. It announces that a case has been initiated and instructs the party to respond or appear.
Citation — A traffic violation notice or court-issued document compelling a civil defendant to respond. May be issued at the scene by law enforcement or by the court.
Civil Summons — Most often accompanied by a complaint or petition. The summons notifies the defendant that a civil action has been filed against them and specifies the deadline to respond.
Administrative Summons — Issued by government agencies such as the IRS under IRC Section 7602. Note: administrative summons are typically not served by private process servers.
In most U.S. jurisdictions, the service of a summons is required for the court to have jurisdiction over the party being summoned. The form and content of service in the federal courts is governed by Rule 4 of the Federal Rules of Civil Procedure.
